RETURN FOR DEFECTIVE, DAMAGED OR NON-CONFORMING PRODUCTS.
Return for defective, damaged or non-conforming product. If the customer receives a defective product,
damaged during transport or not conforming to what was ordered, is entitled to a replacement or to the
reimbursement.
Is it possible to make a return? Yes. Upon delivery, it is up to the customer to check the quantity and status of the
products.
Within how many days? Any anomalies, defects or non-conformities (e.g. missing items, products
damaged) must be reported to LA BRASILIANA within 7 (seven) days of receipt of the
products.
How is it requested? The customer must contact Customer Services, collect the goods subject to the
contents” on the courier's consignment note and keep the invoice and the consignment note itself.
Who pays the shipping costs? In the event of a return for a defective, damaged or non-conforming product, the
shipping costs for the return and any new shipment will be borne by LA BRASILIANA.
Method of refund/resolution: Upon agreement with the Customer, LA BRASILIANA will provide
replacement products of equal commercial value or the issuance of a refund by credit to
of the Customer, usable for future purchases.
(a) International Sales.
European Union (EU) countries: This return and refund policy applies in full to all
Consumer Customers residing in the European Union, in accordance with Directive 2011/83/EU on the rights of the
consumers. The rights described here are guaranteed in all member states.
Non-EU countries: For purchases with delivery in countries outside the European Union, there may be
different conditions apply, in particular with regard to shipping costs, customs charges and

b) Products excluded from the right of withdrawal and return.
In accordance with Article 59 of the Consumer Code, for hygienic and sanitary reasons, they are
excluded from the right of withdrawal and return:

Coffee, capsules, pods, biscuits, chocolate, sugar and other foodstuffs, purchased at the premises or
through online or telephone channels, which risk deteriorating or expiring quickly. Once the

safety, proper storage and suitability for resale. For these reasons, returned food products
cannot be put back on the market and must be destroyed. Added to this are considerations of
sustainability related to the courier's pick-up of the product and its environmental impact.
For purchases made on the premises, once you leave the point of sale, you will not be able to exchange
or replacement of foodstuffs. It is therefore the customer's responsibility to verify quantity and condition
of the products upon delivery and report any anomalies to the staff before leaving the
shop.
d) Exceptions
Returns are only permitted if the defect was not reasonably detectable at the time of purchase
(e.g. crushed capsules inside a sealed package, packaging defects not visible externally) or
in the event of an error on the part of LA BRASILIANA with respect to the order placed. In such circumstances, LA BRASILIANA
may proceed with replacement after verification.
RIGHT OF WITHDRAWAL
In accordance with Art. 52 of the Consumer Code, the Customer acting as a Consumer has the
right to withdraw from the concluded purchase contract.
Within how many days? The right of withdrawal must be exercised within 14 calendar days from the day of

How is it requested? To exercise the right of withdrawal, the Customer must inform La BRASILIANA of its

communication must allow identification of the customer and the contract.
Return of the product: The customer must return the goods to LA BRASILIANA, at the address that will be
communicated by our Customer Service, without undue delay and in any case within 14 calendar days of the
day on which it communicated its withdrawal.
Who pays the shipping costs? Direct shipping costs for the return of products are borne by
of the Customer.
Refund conditions: Refunds are conditional on the substantial integrity of the returned products. The goods
must be returned in perfect condition, unused, and in their original packaging complete with all
accessories. The Customer shall be liable for any decrease in the value of the goods resulting from handling
other than what is necessary to establish the nature, characteristics and functioning of the goods.
How quickly and how is the refund made? LA BRASILIANA will refund the
payments received from the Customer, including shipping costs invoiced at the time of purchase, within 14 days of the
day on which it is informed of the decision to withdraw. The refund will be made using the same method
payment method used by the Customer for the initial transaction, unless the Customer has expressly
agreed otherwise. LA BRASILIANA may withhold reimbursement until it has received the goods or
until the customer has proved that they have been returned, whichever comes first.
These conditions shall also apply to returns from the Vatican City, Republic of San Marino,
Livigno and Campione: in this case LA BRASILIANA will pay for customs permits and the
taxable taxes.
The conditions of withdrawal set out in this Article apply exclusively in respect of Consumers
Europeans.
